Challenges to prior convictions is not limited to only those convictions which occurred in Georgia. Challenges to prior convictions in other states can also be successful. If a person is convicted of drunk driving in another state, Georgia courts cannot count that conviction if the laws under which the conviction was adjudicated were not very similar to Georgia laws at the time of the conviction. For example, if a person was convicted of operating under the influence in Illinois, and the Illinois laws at the time of that conviction were not similar to the current laws in Georgia under which a conviction is being sought, then challenging those priors successfully prevents the court from using them in the current charge. In some cases, that can mean that the current charge is reduced to a lesser misdemeanor, but it can also mean that the current charge is reduced to a non-criminal charge (a first operating under the influence offense in Georgia). In many instances, attorneys who do not frequently litigate drunk driving cases may not realize that they need not agree to priors. By refusing to stipulate to the prior convictions, an attorney forces the prosecution to produce certified evidence for the prior convictions.
