saving your driver's license
Will you automatically lose your driver's license if you are arrested for an operating under the influence offense?
That depends on the number of prior convictions on your record (from this or any other state), and whether you refused to submit to a test to determine whether your blood alcohol concentration level exceeded the statutory limit at the time of the test, or agreed to the test (discussed next).
submitted to bac test
If you submitted (or were forced to submit) to a breath or blood test to determine your blood alcohol concentration level (BAC), and those test results indicated that your BAC was over the stautory limit (.08 for a third or lesser offense, or .02 for fourth or higher offenses), you will receive a Notice of Intent to Suspend form from the Department of Transportation.
10 days to file
You have ten (10) business days from the date of the Notice of Intent to Suspend to file an administrative review request.
The Notice of Intent to Suspend form serves as your temporary driving permit for thirt (30) days from the Notice date. The Notice includes additional information. At the end of the thirty (30) days, your driving privileges will be suspended if 1) an administrative review request was not filed timely, or b) the administrative review hearing was lost (the administrative review judge upheld the suspension). You may however be elegible for an occupational license.
If you have not yet hired an attorney, please contact an attorney right away. If you have hired Attorney Wood, her firm will represent you at the administrative review hearing.
